Frequently Asked Questions

Do you represent the buyer or the seller?
The great thing about a short sale is that it is truly a win-win-win for all parties. The lien holders maximize their proceeds from a distressed asset, the seller is able to avoid foreclosure and settle their debts, and the buyer is able to get a property at a price they desire. In a short sale transaction negotiated by Ark Law Group, the seller has selected the buyer's offer as the one to use to get their debt settled. At that point we are representing that offer to the lender as the highest and best offer, and do everything in our power to get the deal closed, with no additional money required to be brought to closing. We have many buyers who insist that Ark Law Group negotiate all of their purchases do to our tireless representation of their offer.
What are the benefits of doing a short sale?
There are many benefits to a short sale. One benefit to all homeowners is that a short sale allows them to avoid having a foreclosure on their credit report. A foreclosure can stay on the credit report for up to seven years. If you have a 2nd mortgage on the property, the benefit is that you can potentially settle the debt entirely in the short sale vs having the debt remain after a foreclosure. In many states, the 2nd lender has the right to pursue the borrower for the entire amount of the deficiency, and garnish the borrower’s wages until it is repaid. A huge benefit is the potential $10,000 relocation incentive paid by the government. Lastly, in our experience, homeowners get peace of mind once they make a decision to sell their home and leave behind months if not year’s of struggle with their mortgage.
What is better, a foreclosure or a short sale?
Many people think that a short sale means that they lose their home, so why not just let it go to foreclosure? Unfortunately, that thinking can come back to haunt them, when the lender pursues them for a deficiency balance on the loan, or they are prevented from buying a new house once their finances stabilize. Many of our clients stop making their payments, live in their house payment free for many months, and then, 5-6 months prior to the foreclosure, initiate the short sale process. This gives them the benefit of being able to save some money to help them move into a new place.
How long does the short sale process take?
On the short end, it could all be wrapped up and done within 3 months. In general though, plan for 3-6 months. The property needs to be listed, a buyer needs to be found, the lender needs to collect all their necessary documents and review them, the lender needs to do a valuation of the property, and then, finally, they can review the offer. In most cases, the lender’s review is just the first step in getting the short sale approval. They will typically have to send the file to Fannie Mae or Freddie Mac for final approval.
I don't like being left in the dark by my short sale negotiator. How do you address that?
We will never leave you in the dark. To back that up, we have created an environment where you are basically able to look over our shoulders as we work on your file. Everything we do goes into our online Case Notes, and is broadcast out to you via an email and an alert on an app on your smartphone. Whether the news is good or bad, we feel it is critical to get it out immediately, so that course corrections can happen as soon as possible. We are able to provide updates to any and all parties to the transaction as necessary, under your instructions. We care about ALL parties in the transaction, not just the listing side. As the buyer is paying our fee, they should know what is going on, and be just as informed as the sellers as to the progress of the negotiations. Lastly, we understand that you are busy, and may not have either the time or experience to properly update and counsel all parties, and we gladly will take the lead and relieve that burden. We have found that transparency, communication, and good counsel keeps deals together and gets them closed in the most timely manner possible.
